need advise on a expansion valve- yes or no

You can use a txv.

Just stop by your supply house and tell them you need a 4 ton for R22. Grab a couple fittings incase the pipe sizes are different. Either cut the old orifice housing out and repipe it or just remove the piston and leave it empty.
