I too am on the Board of my brand new NYC Condo who unfortunately used Evergreen PTAC units that are a major headache. Sound similar we have a lawyer and an engineer checking out all things sponsor related........
My question is......have you found another service company willing to come and do the work on the units?

I bought a condo last summer that was newly constructed in New York City. I am the Owner rep to the board which is controlled by the sponsor.

We have Evergreen Model KHSY PTAC units and were miserable last summer. We had the sponsor reluctantly hired an independent contractor who stated that the PTACs are properly sized (see attachment), but our counsel (out of pocket) has an engineering degree, and he suspects that insulation is the problem.

Facts:
-Last winter was mild in New York and the PTAC were adequate. Last summer was terrible, and besides >$500 electric bills, the room temp were 80-90%. I could not sleep in my master bedroom last summer, but the smaller bedroom was sufficiently cooled by PTAC.
-Per offering plan, the unit is designed to provide sufficient cooling to maintain inside conditions of 76 degrees Fahrenheit and 50% relative humidity, when the outside conditions are 92 degrees Fahrenheit dry bulb & 73 wet bulb (?) It did reach the 100 last summer.

From what I have described, can insulation be the cause of poor cooling, even though the apt were warm during the coldest days in winter?
